JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-09-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 13.09.2021, within four weeks. Heard learned counsel appearing on behalf of petitioners and learned A.P.P. appearing for the State. This application is filed for modification of order dated 22.06.2020 passed in Criminal Miscellaneous No. 81764 of 2019.

Learned counsel appearing on behalf of the petitioners submits that the petitioners have been granted prearrest bail on 22.06.2020 passed in Criminal Miscellaneous No.

Patna High Court CR. MISC. No.53166 of 2021(2) dt.29-09-2021 2/2 81764 of 2019 with a direction to surrender before the court below within a period of four weeks on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Kishanganj or the successor Court, in connection with Tedha Gachh P.S. Case No. 120 of 2019, but, due to some unavoidable circumstances, the petitioners could not surrender before the Court below within the stipulated time. In such view of the matter, let the time to surrender of the petitioners, as ordered on 22.06.2020 passed in Criminal Miscellaneous No. 81764 of 2019, be further extended by four weeks from today.

Accordingly, the modification application is allowed and the order dated 22.06.2020 passed in Criminal Miscellaneous No. 81764 of 2019 is modified to the above extent.

This application stands disposed of.
