The petitioners are in custody since 20.06.2017 in connection with Barachati (Mohanpur) P.S. Case No. 369 of 2017 for the offence registered under Sections 302/201/34 of the Indian Penal Code.

The petitioners are husband and father-in-law respectively of the deceased lady, who is said to have disappeared from her matrimonial home and thereafter, it is alleged that her burnt dead body was recovered from the forest by the Chowkidar. Learned counsel for the petitioners submits that though these two petitioners are languishing in jail and the trial has commenced, it has now come on record that the informant has

Patna High Court Cr.Misc. No.43072 of 2018 (3) dt.27-07-2018 been declared hostile and has stated in his cross-examination that he had put his thumb impression on a piece of paper as instructed by the Officer in-charge who has drawn up the first information report.

Considering the aforesaid facts and circumstances of the case and that the petitioners have no criminal antecedents, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 369 of 2017.
