For the Petitioner/s :

Mr. Rajani Kant Pandey, Advocate For the Opposite Party/s :

Mr. Umesh Lal Verma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-01-2023 Heard learned counsel for the petitioners, learned APP for the State and perused the case diary. The petitioners are in custody in a case registered for the offence punishable under Sections 8 (C), 20(b)(ii)(c), 29 and 27(A) of the NDPS Act.

Allegedly, it is a case of recovery of ganja weighing 668.56 Kg. Ganja kept in 22 gunny bags.

Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He further submits that the petitioners are driver and cleaner of the truck and they had no knowledge of illegal substance loaded in the said truck. The petitioners are in custody since 19.02.2022.

Patna High Court CR. MISC. No.41224 of 2022(3) dt.10-01-2023 2/2 Learned APP appearing for the State has vehemently opposed the prayer for regular bail and submitted that the huge quantity of alleged ganja was recovered from the possession of the petitioners loaded in a truck and they have also confessed their complicity in this case.

After considering the aforesaid facts and circumstances of the case, I am not inclined to grant regular bail to the petitioners.

Prayer for regular bail of the petitioners is rejected. However, the trial Court is directed to conclude the trial expeditiously.
