The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 409/34 of the Indian Penal Code.

The prosecution case is that the informant was returning after withdrawing Rs.30,000/- under the Indira Awas Scheme when the husband of the Panchayat Mukhiya, namely, Amanullah Ansari and his nephew Firoz Ansari were standing there and Amanullah Ansari demanded Rs.20,000/- as extortion when the informant made protest then Firoz Ansari forcibly snatched Rs.17,000/- from the possession of the informant. Though, the petitioner was not named in the FIR but

Patna High Court Cr.Misc. No.33871 of 2015 (2) dt.31-08-2015 2/2 during investigation through video clipping it transpired that after snatching the money from the informant the money was given to the petitioner.

Considering the fact that thrust of accusation is specific against co-accused Amanullah Ansari and Firoz Ansari, who have been granted anticipatory bail vide Cr. Misc. No. 3860 of 2014 on deposit of Rs.17,000/- and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bela P.S. Case No. 109 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
