JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 18.01.2017 passed in Cr. Misc. No. 47314 of 2016 as well as vide order dated 13.12.2017 passed in Cr. Misc. No. 55125 of 2017 in connection with Mansi P.S. Case No. 234 of 2015.
Submission of learned counsel for the petitioner in spite of direction of this Court to conclude the trial within a period of six months, the trial has not been concluded and petitioner has been in custody since long.
Heard learned A.P.P. also.
Having heard both sides, earlier a report was called for with regard to stage of trial, from which, it appears that the case is pending only for examination of Investigating Officer and
Patna High Court Cr.Misc. No.43173 of 2018 (3) dt.01-08-2018 2/2 as the Presiding Officer was on leave, the trial was pending. In view of the above facts I am not inclined to enlarge be the petitioner on bail. However, the trial court is directed to expdite and conclude the trail as soon as possible and if the Presiding Officer continues to remain on leave, the concerned District Judge shall transfer the case from him, so that the trial be concluded expeditiously.
With the above observation and direction, this application is dismissed.
