JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Through the present application the petitioner has renewed his prayer for anticipatory bail in connection with Dhanarua P.S. Case No. 181 of 2011 registered under Section 498A of the I.P.C.
The petitioner was granted provisional anticipatory bail vide order dated 09.11.2011 passed in Cr. Misc. No. 36189 of 2011 for one year on the undertaking that petitioner is ready to keep the informant as wife with dignity and honour. The provisional bail of the petitioner was to be confirmed by learned Court below on substantial restoration of matrimonial harmony or if the informant deliberately refuses to reside with the petitioner. Subsequently the period of provisional bail was extended vide order dated 03.04.2013 passed in Cr. Misc. No. 3060 of 2013.
It is submitted by learned counsel for the petitioner that due to non-cooperation of the informant the
Patna High Court Cr.Misc. No.43123 of 2013 (4) dt.04-02-2015 2/2 matrimonial harmony could not be restored. Hence the petitioner has filed the present second anticipatory bail application.
This Court is not inclined to entertain the second anticipatory application.
Accordingly the application is dismissed.
