ANJANA MISHRA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147, 448, 323, 313 and 504 of the Indian Penal Code. Learned counsel for the petitioner submits that the present First Information Report has been occasioned on account of rivalry between the parties and a counter case has also been registered. He further submits that the present First Information Report was lodged after a lapse of forty days for which no plausible explanation has been given by the informant. Considering the aforementioned submission and also the fact that there is case and counter case between the parties and that the petitioner has also been made accused by the same informant

Patna High Court Cr.Misc. No.32621 of 2015 (2) dt.18-08-2015 P2/2 in Khaira P.S. Case No. 195 of 2013, let the petitioner Basant Manjhi, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Khaira P.S. Case No. 153/14 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
