The petitioner seeks regular bail in connection with Sahar P.S.Case No.15 of 2017, registered for offences punishable under Sections 498(A) & 302/34 of the Indian Penal Code. The petitioner is husband of the deceased and the case is under Section 302 of the Indian Penal Code. There is allegation that the petitioner caused death of the petitioner by administering poison.
It is submitted on behalf of the petitioner that the materials available in the case diary clearly shows that she has committed suicide as she was demanding ornaments from the petitioner and his mother but the same has not been fulfilled. It is also submitted that son of the petitioner has also been examined in this case and he has also stated so as well as the other villagers have also stated so before the police. The petitioner is in custody for about four

Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of the fact that the case is under Section 302 of the IPC and the statement of the son of the deceased also shows that she had committed suicide, as such, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-X, Ara at Bhojpur in connection with Sahar P.S.Case No.15 of 2017. With following conditions :
(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
