The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,307 and 504/34 of the Indian Penal Code.

The accusation against the petitioner is of assaulting with farsa on the head of the informant.

It is submitted by the learned counsel for the petitioner that the injury has been found to be simple and there is no accusation of repeating the blow, hence it cannot be said that the petitioner had any intention to kill and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.33078 of 2015 (2) dt.11-08-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Akbarpur P.S. Case No. 85 of 2015 pending in the court of learned CJM, Nawada. This application is disposed of with the aforesaid observation/direction.
