The petitioner seeks bail in Alamnagar P.S. Case No. 36/2016, registered for the offences punishable under Section 47(A) of Excise Act.

The informant is A.S.I. and he in his self-statement alleged that during course of checking of vehicles, he saw a person carrying a bag on his bicycle and seeing the informant the said person escaped leaving his cycle and bag there. The police, on search, recovered 48 bottles of country made wine, each containing 400ml. Local people disclosed the name of this petitioner who seeing the police party escaped from there. It is submitted on behalf of the petitioner that admittedly the liquor was recovered from the spot, but the same

Patna High Court Cr.Misc. No.54213 of 2016 (2) dt.21-12-2016 2/2 has not been recovered from possession of the petitioner. The petitioner is in custody for more than four months. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Uda Kishunganj, Madhepura in connection with Alamnagar P.S. Case No. 36/2016.
