The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 342, 324, 379, 506 and 34 of the Indian Penal Code. As per the prosecution case, it is stated that the three named accused persons including the petitioner herein surrounded the informant. Co-accused Brijesh Mahto gave a knife blow causing injury on the informant. The petitioner caught hold of the informant. It is further stated that Akhilesh Mahto ordered that he should be killed and three unknown accused persons caught hold of him. Thereafter, on other persons of his tola reaching there, the informant was saved. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Patna High Court CR. MISC. No.51101 of 2021(2) dt.24-02-2022 2/2 overt act has been alleged against the petitioner who is in custody since 14.6.2021. The specific allegation of assault is against Brijesh Mahto. Charge sheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR together with the petitioner having remained in custody for 8 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Chanpatia (Kumarbagh O.P) P.S. Case no. 230 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Bettiah, West Champaran.
