2. The petitioner seeks bail in connection with Sirdala (Meskaur) P.S. Case No. 559 of 2022 dated 06.09.2022, instituted for the offence punishable under Sections 341, 323, 325, 307 & 34 of the Indian Penal Code.

3. The prosecution case, in brief, is that on 15.09.2022, the petitioner along with other co-accused persons came to install Khunta in the land of the informant and on objection, they brutally assaulted informant's uncle, sister and other family members.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is a case and

Further, it is submitted that another co-accused persons, namely, Arjun Prasad and Ajeet Kumar have already been granted bail vide order dated 27.03.2023 & 11.04.2023 passed by a Co-ordinate Bench of this Court passed in Criminal Miscellaneous No. 69051 of 2022 & Criminal Miscellaneous No. 6082 of 2023 respectively. Lastly, it has been submitted that the petitioner is in custody since 22.05.2023 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Nawada in Sirdala (Meskaur) P.S. Case No. 559 of 2022.
