ANJANA MISHRA ORAL ORDER 17-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Katra P.S. Case No.29 of 2014 for allegedly having committed the offences under Sections 395 and 397 of the Indian Penal Code.
Learned counsel for the petitioners submits that the present case has been occasioned on account of the family dispute as the informant and the petitioners are Gotiyas and a partition suit, bearing Partition Suit No.91 of 2014, has been registered, which is pending in the court of the Additional Judge-I, Muzaffarpur. Learned counsel for the petitioners further submits
Patna High Court Cr.Misc. No.32319 of 2015 (2) dt.17-08-2015 2/2 that it is on account of the land dispute between the parties and the petitioners have claimed their respective shares, that the present case has been lodged.
Considering the aforementioned facts and circumstances and the nature of allegations and also the fact that the petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Katra P.S. Case No.29 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
