Petitioner is languishing in custody since 27.09.2016 in connection with Chiraiya P.S. Case No. 41 of 2016 for offences punishable under Section 365/34 of the Indian Penal Code.
Petitioner Manoj Mahto is full brother of coaccused Binod Mahto.
The husband of the informant telephonically reported to the informant that he was along with petitioner in the night of 10th March, 2016 and subsequently his dead body was found. Hence, the petitioner is under suspicion. Submission of the petitioner is that no motive is alleged against the petitioner nor the learned Court-below has found any substantial material against the petitioner after perusal
Patna High Court Cr.Misc. No.53214 of 2016 (2) dt.08-12-2016 2/2 of the case-diary while refusing the prayer for bail. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sikrahna at Dhaka, East Champaran, in connection with Chiraiya P.S. Case No.41 of 2016.
