The petitioners apprehend their arrest in connection with Uchakagaon P.S. Case No.43 of 2019/G.R. No.403 of 2019 registered under Sections 363 and 366(A)/34 of the Indian Penal Code, pending in the court of the Additional Chief Judicial Magistrate-IX, Gopalganj.

The accusation is of kidnapping the daughter of the informant by Rajesh Sah with the help of his father (petitioner no.1) and mother (petitioner no.2) for the purpose of marriage. It is also alleged that in the kidnapping of the daughter of the informant, there is also hand of his villager Firoz Ali. Later on,

Patna High Court CR. MISC. No.38514 of 2019(4) dt.01-10-2019 2/2 the informant came to know that his daughter moved from the house with cash Rs.62000/-.

Learned counsel for the petitioners submits that due to love affair, the daughter of the informant moved with Rajesh Sah but with an ulterior motive, the petitioners, who are parents of Rajesh Sah, have also been implicated in this case. Later on, it came to know that Rajesh Sah, the son of the petitioners, and the daughter of the informant, have performed the marriage on 15.02.2019, which would appear from Annexure-2 to this application.

Having considered the facts and the circumstances of the case, the provisional anticipatory bail, as granted to the petitioners vide order dated 12.07.2019 passed by a Bench of this Court, is, hereby, confirmed.
