JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2023 The present writ petition has been filed seeking the following reliefs :- " A) A writ in the nature of MANDAMUS or any other appropriate writ/s, order/s, direction/s commanding the respondents for the following :

(i) To hold that the Petitioner be entered into Flat No. 205 situated at Abhiyanta Nagar, Jalapur, Rupaspur, District- Patna under the name and style of Shreyas Garden Apartment.

(ii) To hold that the Petitioner is owner of the aforesaid flat as purchaser in tune of sale deed dated 28.08.2019 and is entitled to reside in the same without any interference of local police officials.

Patna High Court CWJC No.10715 of 2022(2) dt.01-05-2023 2/2 (iii) To hold that the Respondent police officers in collusion with the Private persons are in unlawful possession and to allow him to take possession of duly purchased flat of the Petitioner and the police has no right to stay in the flat and the same is a case of gross police excesses.

(iv) To hold high level departmental inquiry by the top police officials in order to ascertain the truthfulness behind the aforesaid cases and to take action accordingly after the inquiry result."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies, as are otherwise available under the law. Liberty so sought, is granted.
