The petitioner is languishing in custody for the offences punishable under Sections 406/420/467/468/ 471 / 384/34 of the Indian Penal Code.

The FIR would reveal that the informant had invested money with North Bihar Gramin Bank on persuasion of his villager Ravindra Singh and Deepak Singh. When the petitioner was contacted, the petitioner stated to the informant that if his co-villagers are saying so the informant can go ahead. Submission is that Ravindra Singh had ensured that he would refund the entire money of the informant. Learned counsel for the informant opposed the

Patna High Court CR. MISC. No.45344 of 2019(2) dt.23-07-2019 2/2 prayer for bail on the ground that co-accused Bhupendra Singh in whose account the informant had deposited money has been allowed bail with condition that he would refund the money of the informant.

Considering the nature of disputed question of fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Panapur P.S. Case No.1 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
