JUSTICE SATYAVRAT VERMA ORAL ORDER 02-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with S.T. No. 225 of 2021 arising out of Roh P.S. Case No. 66 of 2020 instituted for the offences under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the charges against the petitioner have been framed and petitioner is in custody since 18.01.2021 and is a person with clean antecedent.

The informant alleges that one Ashok Ramani (petitioner) called the informant's father who accompanied him on 11.05.2020 at 06:00 P.M. and when his father did not return

No.50710 of 2021(2) dt.02-02-2022 2/3 the informant and his family members started searching him but could not find him and on 13.05.2020 dead body of the father of the informant was recovered in a water channel. It is further alleged that due to previous enmity, the petitioner along with named accused persons killed his father.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case and from bare perusal of the allegation as alleged in the FIR, it would manifest that apart from suspicion nothing more is there. Learned counsel further submits that the informant alleges that his father was having enmity with Ashok Ramani and the named accused persons then why the father of the informant would have accompanied Ashok Ramani when he was having such enmity that he might be killed by them. Learned counsel next submits that petitioner has not disclosed the nature of dispute and enmity and the entire allegation is based on suspicion. Learned counsel also submits that the father of the petitioner was a habitual drinker and it appears that in an intoxicated condition he fell and died because from the postmortem report also it appears that the deceased had sustained only one injury on his frontal part of his head and the same was not appearing in external examination rather the same was detected on internal examination.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charges have been framed and taking into consideration the submission made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-X-Nawada in connection with S.T. No. 225 of 2021 arising out of Roh P.S. Case No. 66 of 2020.
