JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2018 Heard the parties. The petitioner seeks regular bail in connection with Ghorasahan Police Station Case No. 87 of 2016 ,registered for the office under Sections 366 (A)/34 of the Indian Penal Code. As per F.I.R., allegation against the petitioner is of kidnapping the sister of the wife of the informant, who is minor. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the statement of the victim girl has been recorded under Section 164 Cr.P.C. is contradictory to the F.I.R. and the petitioner is in custody since 14.03.2018.
Heard learned A.P.P. also who opposed the prayer for
Patna High Court Cr.Misc. No.48127 of 2018 (3) dt.27-09-2018 2/2 bail on the basis of statement recorded under Section 164 Cr.P.C. in which it appears that the victim girl supported the prosecution case.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner and accordingly, the bail of the petitioner is rejected.
With the aforesaid observation, this application is dismissed.
