This application for anticipatory bail arises out of Deep Nagar P.S. Case No. 06 of 2019, disclosing offences under Sections, 147, 148, 149, 342, 323, 324, 427, 307, 436, 380 and 302 of the Indian Penal Code.
There are 51 persons named in the FIR and allegedly the named accused persons and 400-500 other persons entered into the house of the informant forcibly and killed her son by assaulting him with Lathi and bricks etc.
Considering the submission made on behalf of the petitioner that there is vague allegation against all the persons named in the FIR of assault and that prior to lodging of the present FIR, an FIR was lodged against the informant and her
Patna High Court CR. MISC. No.37876 of 2019(2) dt.21-06-2019 2/2 family members, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case No. 06 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
