JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Sessions Trial No.177 of 2015 arising out of Sakra (Bariyarpur O.P.) P.S. case No.508 of 2014 instituted for the offence under Sections 147, 149, 448, 452, 436, 341, 323, 326, 307 and 302 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge XIth, Muzaffarpur.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with a direction to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of the order. This is the second attempt for grant of bail on behalf of the petitioner. A report was called for from the Trial Court. The same
Patna High Court Cr.Misc. No.40061 of 2016 (3) dt.05-10-2016 is at Flag 'A'. It has been reported that within a period of one month the trial is going to be concluded.
Considering the aforesaid facts and circumstances and the report submitted by the Trial Court, I am not inclined to grant bail to the petitioner. The same is rejected. (Sudhir Singh, J) Narendra/- U T
