====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 03-07-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Trial No.3812/2018 arising out of Bairiya P.S. Case No.61 of 2016 for offence punishable under Section 384 of the Indian Penal Code. This is a case of misuse of privilege of bail. Earlier the petitioner was granted bail vide order dated 21.10.2016 passed in Cr. Misc. No.39265 of 2016 by this Court with certain terms and conditions, but he has violated the terms and conditions of bail and, as such, his bail bond has been cancelled by the court below.

Counsel for the petitioner submits that he is in custody since 02.02.2019 and the petitioner undertakes that if this time he will be released on bail, he will not misuse the

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Bettiah, West Champaran in connection with Trial No.3812 of 2018 arising out of Bairiya P.S. Case No. 61 of 2016 with a condition that if the petitioner, after his release, is again misused the privilege of bail, then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
