JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-10-2018 The petitioner seeks regular bail in connection with Session Trial No. 277/16, arising out of Town P.S. Case No. 544 of 2014, registered for offences punishable under Sections 302, 307/34, 326/120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner and others is of firing causing death of two persons.
It has been submitted on behalf of the petitioner that he has been in judicial custody for more than three years and uptil now eight prosecution witnesses have been examined and they have not supported the case of prosecution and one of the coaccused has already been enlarged on bail by a coordinate Bench of this Court vide order dated 20.06.2018 passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.46377 of 2018 (3) dt.12-10-2018 27307 of 2018.
Learned counsel for the State opposed the prayer for bail on the ground that the trial is at concluding stage and petitioner is an accused in six other cases.
Having heard both sides, considering the aforementioned facts and circumstances, I am not inclined to enlarge the petitioner on bail. However, since the petitioner has been in judicial custody for more than three years, the trial court is directed to conclude the trial within a period of six months.
