The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3 bottles of 300 ml. each of foreign liquor has been recovered from a motorcycle.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the alleged motorcycle and has got no concern with the seized liquor, but he has been made accused only on suspicion. Petitioner has got clean antecedent. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.42342 of 2022(2) dt.30-09-2022 2/2 from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Special Excise Court - II, Sitamarhi in connection with Nanpur P.S. Case No. 216 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
