JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-07-2021 As prayed for, through Video Conferencing, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide its notes dated 21.12.2020, within four weeks of starting of the Court proceeding in physical mode in normal course.
Heard learned counsel for the petitioners and the learned A.P.P. for the State, through Video Conferencing. The petitioners apprehend their arrest in connection with Baruraj P.S. Case No.233 of 2018 registered under Sections 304(B), 201 and 120(B)/34 of the Indian Penal Code.
The accusation is that the informant Ramsagar Sah performed the marriage of his daughter Pinki Kumari on 05.05.2015 with Munna Kumar, son of Indradeo Sah, but, thereafter, the
Patna High Court CR. MISC. No.37833 of 2020(2) dt.07-07-2021 2/2 daughter of the informant was being tortured by her husband, mother-in-law and brothers-in-law, namely, Ramesh Sah and Umesh Sah, for demand of dowry. Later on, Pinki Kumari, the daughter of the informant, was killed for non-fulfillment of the dowry demand and her dead body was disposed of by all the F.I.R. named accused including the petitioners.
Learned counsel for the petitioners submits that the petitioners are not the relatives of the in-laws of the daughter of the informant and being their co-villagers, they have falsely been implicated in this case. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Ms. P. Kumari, Judicial Magistrate, First Class, West, Muzaffarpur, in connection with Baruraj P.S. Case No.233 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
