JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-07-2019 The petitioners apprehend their arrest in connection with Jokihat P.S.Case No. 18 of 2019 registered under Sections 341, 384, 435, 504 and 506/34 of the Indian penal Code. Allegation against the petitioners is that on the day of occurrence, informant saw that his wooden house and crop bundle was burning and when he came out to see, he found that the petitioner no. 1 was running after setting the things on fire. The allegation made in the FIR is that when the informant went to the accused persons for complaining it, they all including the petitioners started abusing and demanded a sum of Rs. 20,000/- per month as Rangadari.

Learned counsel for the petitioners submits that informant as well as the petitioners are relatives and due to family dispute,

He further submits that petitioner no. 2 and 3 have got no criminal antecedent and petitioner no. 1 has got one more criminal antecedent of Excise Act in which he is on bail. After having heard learned counsel for the petitioners and learned counsel for the State and after perusal of the material on record, it appears that petitioners have got no criminal antecedent except petitioner no. 1 and the parties are related to each other, accordingly, I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Jokihat P.S. Case No. 18 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
