The petitioners seek bail in anticipation of their arrest in connection with Mahua P.S. Case No. 640 of 2019 instituted for the offences under Sections 30 (a), 32(ii), 34(ii) and 41(i) of the Bihar Prohibition and Excise Act, It appears from the prosecution report that one Ajay Rai was apprehended and from his motorcycle, there was recovery of 8.640 litres of liquor. Aforesaid Ajay Rai has taken the name of the petitioners and others who fled away
Patna High Court CR. MISC. No.37462 of 2020(2) dt.08-04-2021 2/2 at the time of the raid. Apart from the aforesaid confessional statement of Ajay Rai, there is no other material to connect the petitioners with the offence.
The petitioners do not have any criminal antecedents.
Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-- Excise Court, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 640 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
