JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-07-2019 This application, for grant of anticipatory bail, arises out of Kadwa P.S. Case No. 99 of 2019, disclosing offences under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Allegation as per the written report of the informant is that the petitioners and others came variously armed and assaulted the informant by means of farsa.

Submission of learned counsel for the petitioners is that petitioners are own brothers of the informant and there is partition between the informant and petitioners and the land was demarcated and when the petitioners were making construction

Patna High Court CR. MISC. No.40661 of 2019(2) dt.02-07-2019 2/2 over their land, informant objected and due to which, some altercation took place and the injury caused to the informant was found to be simple in nature, which will appear from annexure -2 of the petition.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Cheif Judicial Magistrate, Katihar, in connection with Kadwa P.S. Case No. 99 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
