JUSTICE SANJAY PRIYA ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Spl. POCSO Case No. 54 of 2017 arising out of Ranitalab P.S. Case No. 55 of 2017 instituted for the offence under Sections 354/34 of the Indian Penal Code, Sections 8 and 10 of POCSO Act.
Counsel for the petitioner submits that petitioner has voluntarily surrendered on 29.05.2018 and since then he is in custody.
In the written report there is allegation against the petitioner that he along with another accused person always used to tease the informant. On the date of occurrence, they caught hold the hands of the informant and started dragging her. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.49190 of 2018 (3) dt.26-09-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I-cum-Special Judge, POCSO, Patna, in connection with Spl. POCSO Case No. 54 of 2017 arising out of Ranitalab P.S. Case No. 55 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
