ANJANA MISHRA ORAL ORDER 20-08-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Marauna P.S. Case No. 71/2015 registered for the offences punishable under Sections 376, 379, 504 and 506/34 I.P.C. Learned counsel for the petitioner submits that there is admittedly previous enmity between the parties. Learned counsel further submits that the alleged act had not taken place in which the petitioner is said to have participated. It is further submitted that in the statement made under Section 164 Cr. P.C. the victim lady has not alleged rape and therefore the petitioner should be admitted to the privilege of anticipatory bail. Considering the nature of allegations made and also statement of victim under Section 164 of the Cr.P.C., let the petitioner above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.33004 of 2015 (2) dt.20-08-2015 before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Supaul in connection with Marauna P.S. Case No. 71/2015, G.R. No. 719/2015.
