JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2017 The petitioner seeks regular bail in connection with Sirdala (Meskaur) P.S. Case No. 06/16, registered for offences punishable under Sections 420, 409/34 of the Indian Penal Code. Allegation against the petitioner is of defalcating an amount of Rs. 5, 37, 899 meant for construction of class rooms of the school of which the petitioner is a headmaster. It has been submitted on behalf of the petitioner that now the measurement has been done and the District Porgramme Officer has issued no Objectin Certificate in favour of the petitioner stating that no money was due against the petitioner, which will appear from the supplementary affidavit. Further petitioner has been in judicial custody since 11.01.2017. Heard learned A.P.P. also.

No.26397 of 2017 (4) dt.31-08-2017 Having heard both sides, considering the facts and circumstances of the case and the submission of learned counsel for the petitioner, this application is disposed of with direction to the court below to verify the authenticity of no objection issued by District Programme Officer, Nawadah and if it is found to be true, he shall release the petitioner on bail to his own satisfaction within reasonable period of time, otherwise he is free to pass any order as he deems fit and proper.
