JUSTICE SANJAY PRIYA ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner, learned counsel for the Opposite Party No.2 and the learned A.P.P. for the State. The petitioner seeks bail in a case instituted for the offence under Section 395/397 of the Indian Penal Code. It has been submitted that the petitioner is not named in the F.I.R. and nothing has been recovered from his possession. No Test Identification parade has been made till date. It has been submitted that co-accused, Moidul Haque @ Tuna @ Badshah in his confessional statement stated that one of the accused on the similar allegation has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 2110/2017 dated 23.01.2017.
In the impugned order, the learned Additional Sessions Judge- III has mentioned that name of the petitioner has come on
Patna High Court Cr.Misc. No.4413 of 2017 (2) dt.15-02-2017 2/2 the confessional statement of co-accused, Moidul Haque and the petitioner is in custody since 21.04.2016.
Considering the above facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with G. B. Nagar P.S.Case No. 47 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan, subject to condition that both the bailors will be close relatives of the petitioner.
