The petitioner apprehends his arrest in connection with Bihiya P.S. Case No. 106 of 2019, registered under Section 30(A) of the Bihar Excise Act, 2016.
The accusation is that on receiving secret information about doing business of illicit liquor by the petitioner, informant along with other police personnel reached in the village Mushar Toli and started to search the house in the second room from main road, 46 bottles each containing 180 ml Indian made foreign liquor were recovered.
Learned counsel for the petitioner submits that, in fact, the house which is said to be searched by the informant and
Patna High Court CR. MISC. No.39738 of 2019(2) dt.28-06-2019 2/2 other police personal, is let out by the petitioner on rent to the dancer group and petitioner has no knowledge about keeping illicit liquor in his house but with ulterior motive the present case has been lodged with false allegation.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 4th Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur, Ara, in connection with Bihiya P.S. Case No. 106 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
