The petitioners seek bail in connection with Jaynagar P.S. Case no. 210 of 2018 registered for the offence punishable under Sections 272, 273, 353, 414, 143, 224, 225 of I.P.C. and Section 30(a) of Bihar Excise and Prohibition Act-2016. 420 lts. of foreign liquor is said to have been recovered from pick-up van and five persons including the petitioners were apprehended, but three of them managed to escape due to interference by the mob of villagers. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from conscious
Patna High Court Cr.Misc. No.43486 of 2018(3) dt.09-08-2018 2/2 physical possession of the petitioners. They have no concern either with the seized liquor or with the van in question. As a matter of fact, the real culprits managed to escape with the help of mob of villagers and petitioners who happen to be member of the mob, have falsely been implicated in this case. They have no criminal antecedent. They have been languishing in custody since 29.04.2018.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Jaynagar P.S. Case no. 210 of 2018.
