The petitioner apprehends his arrest in a case under Sections 302/34 of the Indian Penal Code.

The informant alleged that she had gone to market to purchase some articles and also to see her sister-in-law but when she returned, she found her son hanging from the roof of the house. The informant suspected that one year ago Pranav Kumar Sah kidnapped her daughter and solemnized marriage with her. Pranav Kumar Sah and his family members were always pressurizing her to withdraw the case of kidnapping lodged against them. She further alleged that Sunil Kumar Sharma (the petitioner), who happens to be her neighbour, was also pressurizing her to withdraw the case and she suspected that the petitioner and others might have killed her son. It is submitted that

Patna High Court Cr.Misc. No.33973 of 2015 (4) dt.09-12-2015 2/2 no material is collected to show that the petitioner played any role. The petitioner is, of course, the neighbour of the informant. He is not an accused in the kidnapping case lodged earlier by the informant for kidnapping of her daughter. Save and except suspicion, the police has not yet collected any tangible material. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Katihar (Sahyak) P.S. Case No. 146/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
