15-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is seeking regular bail in connection with Parbatta P.S. Case No. 12 of 2017, G.R. No. 214/2017 registered for the offence punishable under Sections 30 and 38 of the Bihar Excise Amended Act.

Learned counsel for the petitioner submits that a bare perusal of the First Information Report would show that seizure has been made from a place which has no concern with the present petitioner. Nothing has been recovered either from the person or residential house of this petitioner. He has been falsely implicated in this case. The petitioner is in custody since 05.03.2017 despite having clean antecedent.

Patna High Court Cr.Misc. No.25983 of 2017 (2) dt.15-06-2017 Learned Additional Public Prosecutor opposes the prayer for bail of the petitioner.

In the facts and circumstances of this case, considering the clean antecedent of the petitioner and the place of seizure which is not the house of this petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 4TH Additional Sessions Judge - cum - Special Judge of Bihar Excise Act, Bhagalpur, in connection with Parbatta P.S. Case No. 12 of 2017, G.R. No. 214/2017.
