JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-06-2017 Heard Sri Diwakar Prasad Singh learned counsel for the petitioner and learned Sri Madan Kumar, A.P.P. for the State. The petitioner is seeking regular bail in connection with Amarpur P.S. Case No. 240 of 2015 for offence registered under Sections 341, 323, 504, 386 and 307/34 of Indian Penal Code, Section 3/4 of the Explosive Substances Act and Section 27 of the Arms Act.

Learned counsel for the petitioner refers the First Information Report and submits that altogether five persons, including the petitioner, had been named in the F.I.R. and the allegation against them are that they abused, while searching the husband of the petitioner in her house. It is specifically stated that two persons, namely, Raja Kumar and Raj Kumar Tanti entered

The allegations are of demanding ransom of Rs. 50,000/-, causing bomb blast and firing in order to intimidate the villagers. Learned counsel further submits that co-accused Sintu Singh has been granted Anticipatory Bail on 15.07.2016 in Criminal Miscellaneous No.24925 of 2016 and Bablu Singh has also been granted regular bail by a co-ordinate Bench of this Court on 17.05.2017 in Criminal Miscellaneous No. 23539 of 2017. He further submits that the case of the present petitioner is similar to the co-accused.

Learned A.P.P. opposed the prayer for bail.

However, considering the nature of allegations and the fact that the petitioner has no criminal antecedent as also the co-accused have been granted anticipatory bail as well as regular bail in the present case, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 240 of 2015.
