The petitioner apprehends his arrest in connection with Karaghar P.S. Case No. 40 of 2014 registered for the offences punishable under Sections 302, 201, 120-B of the Indian Penal Code.

Learned counsel for the petitioner submits that on recovery of the dead body of one Shobha Nath Pandey in the field, the brother of the said deceased had identified her body and only because the petitioner as well as some others were vendees of lands, in which said Shobha Nath Pandey had participated as a broker, the name of the petitioner has been brought into the present case on mere suspicion. It is further submitted that similarly situated other persons, named by the brother of the deceased on mere suspicion have been extended the privilege of anticipatory bail vide order dated 30.07.2015

Patna High Court Cr.Misc. No.33014 of 2015 (2) dt.21-08-2015 passed in Cr. Misc. No. 12098 of 2015 and its analogous cases. Considering the aforesaid submissions and also the fact that similarly situated accused persons have been extended the privilege of anticipatory bail by this Court, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sasaram, Rohtas in connection with Karaghar P.S. Case No. 40 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
