JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 16-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Belaganj P.S. Case No. 23 of 2020 instituted for the offences under Sections 370/34 of the Indian Penal Code and 14(1) of the Child and Labour Act.

Learned counsel for the petitioner submits that the petitioner has wrongly been sought to be arrested in a case relating to the Child Labour Act. It is the persons who were present in the shop were the younger brothers of the petitioner and came there for taking fast food as is apparent from the report submitted by the Labour Inspector.

I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
