JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2022 The present petition has been filed for modifying the order dated 15.12.2021 passed in Criminal Miscellaneous No. 55813 of 2021 to the extent the petitioner has been directed to mark his presence before the officer-in-charge of the concerned police station at 10 am. on every Monday and instead, substitute the said condition by granting liberty to the petitioner to mark his presence before the officer-in-charge of the concerned police station once a month.

The learned counsel for the petitioner has submitted that the petitioner is working at

Patna High Court CR. MISC. No.40672 of 2022(2) dt.09-11-2022 2/2 Islampur, hence, he has to travel all the way to Kishanganj to mark his attendance resulting in him having difficulty in earning his living.

Having regard to the facts and circumstances of the case and considering the averments made in the present petition, I deem it fit and proper to direct the petitioner to mark his presence before the officer-in-charge of the concerned police station once a month, instead of every Monday of the week, starting with effect from 14th of November, 2022.

The present petition stands disposed of with the aforesaid modification in the order dated 15.12.2021 passed in Criminal Miscellaneous No. 55813 of 2021.
