JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 376, 504/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this court taking note of allegation levelled against him but again this bail petition has been filed and it is argued that report of D.N.A. test negates the allegation levelled against the petitioner.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody and also taking note of report of D.N.A. test, let the petitioner be released

Patna High Court Cr.Misc. No.33844 of 2017 (5) dt.15-11-2017 2/2 on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Araria in connection with Sessions Trial No. 242 of 2016 arising out of Jokihat (Mahalgaon) P.S. Case No. 64 of 2013.
