The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302, 201 and 120(B) of the Indian Penal Code. As per prosecution case, the allegation against the petitioner is of killing the husband of the informant (second wife of the deceased).
It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. He has falsely been implicated in the present case merely on the basis of suspicion. The petitioner happens to be the son-in-law of co-accused Chandan Devi and Sanjay Sada and only for that reason he has been implicated in the present case. There is no eye witness to the alleged occurrence. It is further submitted that there is no specific allegation
Patna High Court CR. MISC. No.44046 of 2023(2) dt.21-07-2023 2/2 against the petitioner. Similarly situated other co-accused namely Sanjay Sada has already been granted bail by this Bench vide order dated 17.03.2023 passed in Cr. Misc. No. 56902 of 2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The petitioner is languishing in judicial custody since 02.03.2021.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bakhtiarpur P.S. Case No. 63 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-VII, Saharsa.
