2. The petitioner has prayed for bail in connection with Arwal P.S. Case No. 393 of 2025 registered for the offence punishable under Section 309(4) of the B.N.S., 2023.

3. The case of the prosecution, in short, is that two miscreants intercepted the informant and looted Rs. 1,08,000/- from the informant and fled away.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the FIR was lodged against unknown miscreants. During the course of the investigation, the name of

He also submits that nothing has been recovered from the petitioner's possession. He further submits that from perusal of the order of the learned trial court, it will transpire that in para-13 of the case diary, it has come that the amount which is said to be looted has been recovered and was handed over to the informant. He further submits that similarly situated co-accused, namely Kamal Kishor Singh, has been granted bail by the learned coordinate Bench of this Court vide Cr. Misc. No. 37452 of 2026. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 30.01.2026.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case
