The matter at issue is payment of contractual dues of the petitioner for the works already done by him. From the materials available on record, this is apparent that the amount claimed by the petitioner has not been admitted by the respondents, rather they are disputing his claim. In above view of the matter, learned counsel appearing on behalf of the petitioner has fairly submitted that the petitioner may be permitted to withdraw the present writ petition with a

Patna High Court CWJC No.3502 of 2010 (3) dt.13-02-2015 2/2 liberty to approach the civil court of competent jurisdiction for grant of appropriate relief on the basis of the materials/ evidence produced by the parties.
