14-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is seeking regular bail in connection with Jakkanpur P.S. Case No. 86 of 2017 registered for the offence punishable under Sections 30(a)/38 of Bihar Excise Act, 2016.
Learned counsel for the petitioner submits that seizure has been made from the house of co-accused Tuntun Rai. The allegation against the petitioner is that he along with co-accused were involved in the illegal trade of liquor. He was arrested by police on 03.04.2017. Learned counsel for the petitioner further submits that petitioner has got no criminal antecedent and co-accused Dhiraj Kumar, Monu Kumar and Nitish Kumar
Patna High Court Cr.Misc. No.25748 of 2017 (2) dt.14-06-2017 have been granted regular bail by a coordinate Bench of this Court in Cr. Misc. Nos. 24984/2017, 25910/2017, 24131/2017.
However, learned Additional Public Prosecutor for the State opposes the prayer for bail. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge-Excise, Patna, in connection with Jakkanpur P.S. Case No. 86 of 2017.
