1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Lauriya P.S. Case No. 92 of 2022 dated 07.04.2022 registered for the offence(s) punishable under Section(s) 392 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that petitioner's name in the alleged crime came into light in the statement of apprehended co-accused person, namely, Kundan Kumar Sahni, who has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.45740 of 2022 and several other co-accused persons, namely, Ajeet Singh @ Ajeet Kumar Singh, Anil Kumar, Chandan Kumar Sahani, Ratnesh Sahani and Bechan Bishwa have been granted bail by different co-ordinate Benches of this Court vide orders passed in Cr. Misc.
Patna High Court CR. MISC. No.43370 of 2023(2) dt.24-07-2023 2/2 Nos.36876 of 2022, 36125 of 2022, 38863 of 2022, 45407 of 2022 and 65354 of 2022 respectively. Further submissions are that after petitioner was taken into custody in the present matter the police failed to recover any part of the looted articles from the possession of petitioner and he himself surrendered before the court below and he has been languishing in jail since 01.02.2023 and against him there is criminal antecedent of one case in which he is on bail and he has not been put on Test Identification Parade as yet.
4. Learned APP appearing for the State has opposed the bail prayer.

Having regard to the facts and circumstances of the case and considering the above submissions and mainly the petitioner's case being similar to the above-mentioned coaccused persons who are on bail, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner namedabove be enlarged on bail in connection with Lauriya P.S. Case No. 92 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
