JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2017 The petitioner seeks regular bail in connection with Pear P.S. Case No. 19 of 2017, registered for offences punishable under Section 272, 273 and 120(B) of the Indian Penal Code and Section 30(A), 35(A) & 38(4) of Bihar Excise and Prohibition Act, 2016. Petitioner is named in the F.I.R and Allegation as per F.I.R. is that police on secret information raided the place of occurrence and recovered huge quantity of foreign liquor and on chase apprehended two persons.

It has been submitted on behalf of the petitioner that that he has falsely been implicated in this case, nothing has been recovered from the possession of the petitioner and his name has been disclosed by the accused, who were apprehended on the spot. Moreover, one of the accused, who was apprehended on the spot

Patna High Court Cr.Misc. No.25737 of 2017 (3) dt.29-06-2017 2/3 has already been granted bail by this Court vide order dated 22.06.2017, passed in Criminal Miscellaneous No. 26540 of 2017 and petitioner has been in judicial custody since 24.03.2017. Heard learned A.P.P. also.

Having heard both sides, no doubt in this case huge quantity of liquor has been recovered, however, considering the fact that one of the accused persons, who was apprehended on spot has already been granted bail by this Court, as such, let this petitioner also, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cumSpecial Judge, Excise, Muzaffarpur, in connection with Pear P.S. Case No. 19 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event

Patna High Court Cr.Misc. No.25737 of 2017 (3) dt.29-06-2017 3/3 of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
