The petitioners are apprehending arrest in a complaint case filed with accusation under sections 323,379 and 384 of the Indian Penal Code wherein process has been issued after cognizance being taken.
It is alleged that the accused persons demanded extortion of one lac rupees when petitioner no. 1 and 2 put pistol upon the informant and gave life threatening. It is further alleged that the accused persons snatched gold chain of the informant and threatened to kill when the informant gave twenty five thousand rupees to the accused persons.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.35042 of 2015 (2) dt.19-08-2015 2/2 petitioners that petitioner no. 1 was working at Dharmkanta of the informant and for non-payment of wages Minimum Wages Case No. 27 of 2015 was filed though subsequent to the lodging of the present complaint. It is further submitted that the complaint was lodged on 23.2.2015 for the occurrence of 21.1.2015. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Complaint Case No. 556 of 2015 pending in the court of learned JM Ist Class, Purnea. This application is disposed of with the aforesaid observation/direction.
