Petitioner and one Binod Ram were caught from the house of one of the F.I.R named accused Arun Kumar Rai, while they were refilling liquor in bottles. The police seized bottles of Indian made foreign liquor in huge quantity.

Submission on behalf of the petitioner is that having similar allegation, co-accused Binod Ram has already been granted privilege of bail by a co-ordinate Bench of this Court. Taking note of the aforesaid facts as well as this aspect of the matter that petitioner does not have any criminal antecedent and is languishing in jail custody since 8.05.2016, let
