Petitioners seek bail in Special Case No.3595 of 2019 arising out of Bakhtiyarpur P.S. Case No.116 of 2019 instituted for the offence under Section(s) 30(a) (c) (d) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioners submits that they have no criminal antecedents.

In the written report, it is alleged that police received information that some persons are involved in sale of illicit liquor. The police raided the place and arrested four persons

Patna High Court CR. MISC. No.38596 of 2019(2) dt.28-06-2019 2/2 including the petitioners. Eight persons managed to run away. It is further alleged that police recovered liquor from two places as mentioned in the seizure list.

Counsel for the petitioners submits that alleged recovery has not been made from conscious possession of the petitioners.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No.3595 of 2019 arising out of Bakhtiyarpur P.S. Case No.116 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
